Dimmit County Jury awards $281 million verdict to family of U.S. Veteran killed by tractor-trailer accident
On December 4, 2013, a unanimous jury in Dimmit County, Texas rendered a $281,000,000.00 total verdict against Heckmann Water Resources (CVR), Inc., a subsidiary of Nuverra Environmental Solutions, Inc. (NYSE: NUV) in the case of Jose Luis Aguilar, et al v. Heckmann Water Resources (CVR), Inc., et al.
Carlos Aguilar, 31 and a veteran of 2 recent successful deployments to Afghanistan and Iraq, was killed when a u-joint and driveshaft separated from Heckmann’s 18-wheeler at 67 mph on a 2 lane road because the u-joint cross piece melted from undetected long term insufficient or no lubrication. The 20 lb. driveshaft bounced off the road and crashed through the windshield of Mr. Aguilar’s work truck traveling the opposite direction, striking him in the neck and face. The jury awarded Mr. Aguilar’s surviving mother, father, wife, 7 children and estate $181,000,000.00 in damages and fined Heckmann, by exemplary damages, $100,000,000.00.
